1. Early Access Programme

1.1 What Early Access means

During the Early Access period, ScoreChom is available as a Progressive Web App (PWA) prior to its official launch on Google Play and other app stores. The Service is fully operational and used in live sporting events, but features, pricing, and availability are subject to change without prior notice as development continues.

1.2 Feature availability after launch

Some features that are currently available at no cost during Early Access may become part of a paid subscription tier after official launch. We will provide reasonable in-app notice before any feature transitions to a paid tier. Your continued use of the Service after such changes constitutes acceptance of the updated pricing and terms.

1.3 No formal beta agreement

Use of ScoreChom during Early Access does not constitute participation in a formal beta programme, and does not create any employment, partnership, co-ownership, collaboration, or commercial relationship between the user and CE Web Solutions. Early Access users are not entitled to any compensation, equity, revenue share, future free access to paid features, or any other benefit by virtue of their early use of the Service.

2. About ScoreChom

ScoreChom ("the App", "the Service") is developed and operated by PLH Theron t/a CE Web Solutions, a South African sole proprietorship. The App provides live sports scoring, match history, and team management tools primarily for Netball, Ringball, and Hockey.

By creating an account or using the App, you agree to these Terms of Use and Privacy Policy. If you do not agree, please do not use the Service.

3. User Accounts

You must create an account to save match history and access cloud features. You can register with:

• Email and password
• Google Sign-In

You are responsible for keeping your login credentials secure. You must provide accurate information when creating your account.

Age requirement: You must be 13 years or older to create an account. If you are under 18, you confirm that a parent or guardian has given permission for you to use the Service.

4. Acceptable Use

You agree to use ScoreChom only for its intended purpose — scoring and tracking sports matches. You agree not to:

• Submit false or misleading match results
• Impersonate another person, school, or club
• Attempt to reverse-engineer, copy, or distribute the App's code
• Use the App for any unlawful purpose
• Upload offensive, inappropriate, or copyrighted logos or images without permission

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Intellectual Property & Copyright

5.1 Ownership

The ScoreChom application — including but not limited to its source code, design, user interface, branding, graphics, features, scoring engine, data structures, and all associated documentation — is the sole and exclusive intellectual property of PLH Theron t/a CE Web Solutions ("the Owner"). This ownership is not shared with, transferred to, or diminished by any user, early adopter, tester, contributor, or third party by virtue of their use of, access to, or feedback on the Service.

5.2 South African Protection

Copyright in South Africa is governed by the Copyright Act, No. 98 of 1978 (as amended). Under this Act, copyright in original works vests automatically in the author upon creation — no registration is required. ScoreChom qualifies as an original literary and artistic work and is protected accordingly. Moral rights under the Act protect the Owner's right to be identified as the author and to object to any derogatory treatment of the work.

5.3 International Protection

South Africa is a signatory to the following international copyright treaties, providing automatic protection for ScoreChom in all member countries without separate registration:

• Berne Convention for the Protection of Literary and Artistic Works — automatic protection in 181+ member countries; duration of author's lifetime plus a minimum of 50 years (70 years in the EU, USA, and many other jurisdictions)
• TRIPS Agreement (Trade-Related Aspects of Intellectual Property Rights) — enforced through the World Trade Organization (WTO)
• Universal Copyright Convention (UCC)
• WIPO Copyright Treaty — extends protection specifically to digital works and software

5.4 What is Protected

The following elements of ScoreChom are protected by copyright and may not be copied, reproduced, adapted, or distributed without prior written permission from the Owner:

• All source code (HTML, CSS, JavaScript) and application logic
• Application design, layout, and user interface
• The ScoreChom name, logo, and brand identity
• Scoring algorithms, data structures, and feature concepts as implemented
• Written content, documentation, and marketing materials
• Any icons, graphics, or visual elements created for the App

5.5 Prohibited Acts

Without prior written permission from PLH Theron t/a CE Web Solutions, you may not:

• Copy, reproduce, or distribute the App's code or design in whole or in part
• Reverse-engineer, decompile, or disassemble the App
• Create derivative works based on ScoreChom
• Remove or alter any copyright notices or proprietary labels
• Use the ScoreChom name, logo, or branding for any commercial purpose
• Republish the App under a different name or brand
• Claim partial or full ownership of any feature, concept, or element of the App on the basis that you suggested, requested, or described it — whether in-app, by email, verbally, or through any other channel

Violation of these rights may result in civil and/or criminal proceedings under South African law and the laws of the relevant jurisdiction where the infringement occurs.

5.6 User Content Licence

Match data, team names, and scores that you enter remain your property. You grant PLH Theron t/a CE Web Solutions a limited, non-exclusive, royalty-free licence to store, process, and display your content solely for the purpose of providing the Service. This licence terminates when you delete your account.

5.7 Reporting Infringement

If you believe your intellectual property rights have been infringed, or if you become aware of unauthorised use of ScoreChom's intellectual property, please contact: [email protected]

6. Feedback, Suggestions & Ideas

6.1 Voluntary feedback

Any feedback, ideas, suggestions, improvements, bug reports, feature requests, or comments ("Feedback") that you provide to CE Web Solutions — whether through the App, by email, through social media, verbally, or through any other means — is provided voluntarily and without expectation of compensation or any other benefit.

6.2 Assignment of Feedback

You agree that all Feedback you provide is, and shall remain, the sole and exclusive property of PLH Theron t/a CE Web Solutions. To the extent that any rights in Feedback vest in you by operation of law, you hereby irrevocably assign all such rights — including all intellectual property rights — to PLH Theron t/a CE Web Solutions with full title guarantee, effective from the moment the Feedback is communicated.

6.3 No Ownership Claims from Feedback

No user, early adopter, tester, or third party may claim full or partial ownership of ScoreChom, or of any feature, component, or concept within it, on the basis that they:

• Suggested, requested, or described a feature or improvement
• Reported a bug or identified a problem
• Participated in testing or provided feedback during the Early Access period
• Were involved under any informal arrangement, verbal agreement, or non-disclosure agreement that was not a formal written equity or employment agreement with CE Web Solutions
• Used the App during its Early Access period prior to commercial launch

6.4 Feedback is Not Confidential

Feedback you provide is not treated as confidential information, regardless of any label you attach to it. CE Web Solutions is under no obligation to keep Feedback confidential and may use, disclose, reproduce, or incorporate it into the Service without restriction, attribution, or compensation.

6.5 No Compensation for Feedback

CE Web Solutions is under no obligation to provide compensation, credit, acknowledgement, equity, revenue share, free access, or any other benefit in exchange for Feedback, whether or not that Feedback is incorporated into the Service.

7. Service Availability

ScoreChom is provided "as is". While we strive for high availability, we do not guarantee that the Service will be available at all times. We are not liable for any loss resulting from downtime, data loss, or technical errors.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.

8. Privacy Policy

This section explains how we collect, use, and protect your personal information in accordance with the Protection of Personal Information Act (POPIA), No. 4 of 2013 (South Africa).

8.1 What we collect

• Account data: Email address, display name, profile photo (from Google Sign-In)
• Consent data: IP address, date, time, and Terms version number recorded at sign-up and on acceptance of any updated Terms — retained as a legal record of consent
• Match data: Scores, team names, locations, dates, goal logs you enter
• Usage data: App events (match started, match saved, features used) via Google Analytics
• Device data: Browser type, device type, IP address (collected automatically by Firebase/Google)

8.2 Why we collect it

• To provide and improve the Service
• To sync your data across devices when you sign in
• To maintain a legally compliant record of your consent to these Terms (POPIA requirement)
• To understand how the App is used and fix problems
• To contact you about important service updates (we will not send marketing emails without your consent)

8.3 Where your data is stored

Your data is stored on Google Firebase (Firestore), hosted in the africa-south1 (Johannesburg) region. This means your data stays in South Africa and is subject to South African law. Google Firebase is certified under ISO 27001 and SOC 2/3. Their privacy policy applies to infrastructure handling: policies.google.com/privacy

8.4 Who we share data with

We do not sell your personal data to any third party. We share data only with:

• Google Firebase — for data storage and authentication
• Google Analytics — for anonymous usage statistics
• Law enforcement — if legally required to do so

8.5 Live score sharing

When you activate the "Live" feature, match information (team names, scores, sport) is published to a public URL accessible by anyone with the link. This includes the scorer's display name ("scored by"). You control when to start and stop live sharing.

8.6 Your rights under POPIA

You have the right to:

• Access your personal data held by us
• Correct inaccurate information
• Delete your account and all associated data
• Object to processing of your data
• Data portability — request an export of your match history

To exercise any of these rights, email [email protected]. We will respond within 30 days.

8.7 Data retention

We retain your data for as long as your account is active. If you delete your account, all personal data is permanently deleted within 30 days. Match data shared in live sessions is automatically deleted from our live database after 24 hours. Consent records (IP address, timestamp, Terms version) are retained for legal compliance purposes even after account deletion.

8.8 Cookies and tracking

ScoreChom uses Google Analytics to collect anonymous usage statistics. This uses cookies. You can opt out at any time using the Google Analytics Opt-out Browser Add-on.

9. Advertising

ScoreChom may display sponsor banners provided by CE Web or third-party advertisers. These are static images and do not use behavioural tracking or third-party ad networks. Advertiser content is reviewed by CE Web before display.

Free tier users may see advertising. Paid tier users may have reduced or no advertising (subject to current plan details).

10. Paid Features & Subscriptions

Some features of ScoreChom require a paid subscription or one-time purchase. Features currently available for free during Early Access may transition to a paid tier after official launch — you will be notified in-app before any such change takes effect.

Current pricing is displayed in the App. All payments are processed securely through PayFast or Stripe. CE Web does not store credit card information. Refund requests must be submitted within 7 days of purchase to [email protected].

11. Changes to These Terms

We may update these Terms and Privacy Policy from time to time. We will notify you of material changes by displaying a notice in the App or by email. Logged-in users will be required to review and accept any updated Terms before continuing to use the Service. Continued use of the App after accepting updated Terms constitutes your agreement to those changes.
